This Privacy & Cookies Policy explains how Hopa Digital Ltd. collects and uses personal information when you access our websites and services.

Note: This is a convenience translation. The Hebrew version is the legally binding one.

What Is This Privacy Policy?

Hopa Digital Ltd., Co. Reg. 516802816 (hereinafter: "Hopa Digital" and/or "the Company" and/or "we" and/or "us"), whose registered address is 10 Prof. Dan Shechtman St., Hadera, Israel, respects the privacy of users of the Company's websites, operating at Hopa.Tech, Hopa.Digital, menu.hopa.tech (hereinafter: "the Company's Sites") and any additional address linked thereto at the Company's discretion.

These terms will inform you about the privacy policy governing the Site. They cover, among other things, the manner in which the Company uses information you provide to it and information collected about you when you use the Site.

In this policy, the term "personal information" means any information that can reasonably be used to identify you, including your first and last name, address, phone number, and more.

This policy forms an inseparable part of the Site's Terms of Use. In addition, this policy also applies to your activities and participation in the loyalty club operated by the Company, as well as the various services offered by the Company, whether directly or through a third party, with such modifications as required by the context.

Data you provide will be stored in Hopa Digital's database and processed by the Company, including through third parties, in accordance with applicable law.

Please note that you are under no legal obligation to provide the data you submit when using the Site and/or the Company's services; however, if you choose not to provide information required to operate a service offered on the Site, you may be unable to use those services.

This policy is written in the masculine form for convenience only, but applies to all users of the Site and/or the Company's services of any kind.

Changes to This Policy

We may update this policy from time to time. We will update the date at the top of this policy each time an update is made.

Reporting a Privacy or Cookies Issue

If you believe your privacy has been violated during use of the Site, use of the services, when information is transferred through the Company to a business, or if you have any question regarding privacy and/or the Company's Cookies policy, please contact the Company at: info@hopa.digital and a representative will be available to handle any request, response, question, or complaint.

Submitting Personal Information to the Company

Use of the Site does not require registration or submission of personal information. However, various areas and sections of the Site may require registration and submission of personal information, such as: full name, ID number, address, phone number, active email address, organizational affiliation, and additional details as needed.

Such areas include, among others:

Mandatory fields will be clearly marked. It is hereby clarified that you are under no legal obligation to provide information, and doing so depends solely on your will and consent. However, without providing the information required in mandatory fields (such as contact details to place an order), you will be unable to complete registration, place orders, or use services that require identification.

Marketing communications: During registration you may choose whether to consent to receive promotional materials, updates, and benefits ("marketing communications") from the Company or the business. This consent is separate from acceptance of these terms. If you chose to consent to marketing communications, your information will also be used to send such messages. You may withdraw your consent to receive marketing communications at any time via the "Unsubscribe" link in the message or by contacting the Company.

Please note that a removal request from a specific business's mailing list will apply to that business only, and will not automatically result in removal from other businesses' mailing lists or general system messages from the Company, unless you have explicitly requested this.

We may collect additional information when you contact or correspond with the Company, for example when you submit requests or inquiries.

When you provide personal information about a third party, you declare that you have obtained their explicit consent to provide the information to the Company for use in accordance with this policy.

  • Registration for a business loyalty club through the Company
  • Registration for events organized by the Company or advertised by a business through the Company
  • Registration for the Company's or a business's mailing lists
  • Submitting a CV to the Company or a business advertising through the Company
  • Contacting the Company via online contact forms on the Site

Information Collected During Site Use

When you use the Site, the Company may collect information about your usage habits in relation to the Site or the relevant service, including content you uploaded or published, information you read, pages you viewed, services that interested you, your computer's location and IP address used to access the Site or the relevant service, the type of operating system you use, the type of end device you have, and more.

In addition, the Company may collect and use the services of third parties to collect and analyse anonymous, statistical, or aggregated information in connection with such use, including information relating to your activity on the Site.

Location-Based Services and Push Notifications

When you use the Site or the application, and subject to your device settings, we may collect and use your real-time geographic location data (Geolocation). Location data is used to display relevant nearby businesses, offer area-specific benefits, and improve the service experience (for example: calculating arrival and delivery times).

In addition, we may send push notifications to your device, including updates about order status, promotions, or relevant reminders.

Collection of location data and sending of notifications depend on your consent and your end device's settings. You may block location services or disable notifications at any time through your device's settings menu. Please note that disabling location services may affect our ability to display personalised content to you.

Social Networks and Personal Information You Share

The Company provides Site users with tools for sharing and linking content from the Site via social networks and various online services. Some of the Company's services and activities may also be conducted through third-party online platforms.

Please note that use of such social networks and online services is external and separate from the Site and is subject to those services' own privacy practices. This policy does not apply to the activities of those social networks or any online service operated by a third party.

The Site and online communities may also include content submitted for publication by Site users and participants. Such content may include personal information. Be aware that content you upload to the Site or the relevant service is not private or confidential and you should have no expectation of privacy with respect to it. You should exercise caution and use good judgment when providing personal information that could identify you or others.

Payment Information

The payment processing system on the Site is operated by external payment gateway providers who comply with the strict information security standards prevalent in the industry and in accordance with applicable law.

Credit card details entered in the interface are not stored on the Company's servers; instead they are transferred securely and in encrypted form directly to the payment provider for processing the transaction and/or generating an encrypted payment token for future use (if you so choose).

The Company undertakes that it will make no use of users' payment instrument details other than to process the transaction the customer requested, and that it will not transfer credit details to any third party (other than to the payment provider for the purpose of executing the transaction).

Use of Information

The personal details and information you provide, and information the Company collects during your use of the Site or any of its services, will be used in accordance with this policy or as required by law, for the following purposes:

  • To enable you to use the Site, the content included in it, and the services it offers, including registration and active participation in Site sections and transferring relevant details to the business
  • To identify you during repeat visits to areas that require registration and to save you from re-entering your details each time
  • To improve and enrich the services and content on the Site, including creating new services and content that meet user requirements and expectations, and to modify or cancel existing services and content. Information used by the Company for this purpose will primarily be statistical and will not personally identify you
  • To enable you to customise the Site's services to your preferences
  • To send you marketing information, advertisements, surveys, and benefits from time to time, subject to your having given explicit consent to receive such communications (whether at registration or at another time). Such information may be sent to you by SMS, email, or other electronic means. You may withdraw your consent and remove your details from the mailing list at any time
  • To contact you when the Company deems it necessary
  • For internal analysis, monitoring, and provision of statistical information to third parties
  • For the proper operation and development of the Site in relation to users and businesses
  • To enforce the Site's Terms of Use, to comply with the requirements of any law, regulation, or other legislation, and to assist competent authorities and any third party when the Company in good faith believes it should do so
  • For any other purpose set out in this privacy policy or in the Terms of Use

Disclosure to Third Parties

The Company will not transfer to third parties the personal information you provided or the details collected about your activity, except in the following cases:

  • Where necessary for the proper provision of the Site's or online community's services
  • If you breach the Site's Terms of Use, or if you carry out, or attempt to carry out, through the Site or in connection with it, actions that the Company considers contrary to law
  • If the Company receives a court order or a demand from a competent authority instructing it to provide your details or information about you to a third party
  • In any dispute, claim, suit, demand, or legal proceeding, if any, between you and the Company and/or anyone on its behalf
  • In any case where the Company believes disclosure is necessary to prevent serious harm to your body or property or to the body or property of a third party
  • The Company may transfer your details and information collected as a result of your use of the Site to companies or other organisations related to the Company, provided they use that information only in accordance with this policy
  • For the purpose of providing and sharing anonymous, aggregated, and statistical information with companies or other organisations related to the Company, as well as with suppliers, business partners, advertisers, and any third party, at the Company's sole discretion. The Company will not knowingly disclose your identity to them without your consent
  • If the Company reorganises its activity or the Site's activity within a different framework, or changes its legal structure, including in the event that it transfers the Site's activity and/or any part thereof to a third party - it will be entitled to transfer to the new entity a copy of the information stored about you, provided that entity undertakes toward you to comply with this policy
  • At your explicit request

Where Is Information Stored?

Information the Company collects is stored in its database, hosted by secure server hosting and data backup providers, which may also be located outside Israel.

Additional information, as detailed in this policy, is collected and stored by other companies (such as statistics companies). They too may store information outside the country.

Your consent to this policy also constitutes consent to storing information abroad and transferring it outside Israel's borders.

Information Security

The Company attaches paramount importance to information security in its systems. Information is stored on a secure server to prevent unauthorised access to personal data.

However, there is no certainty that these measures completely guarantee that personal information will not be exposed or stolen from the databases. Therefore, the Company does not undertake, and you cannot reasonably expect, that the services and information systems used by the Company will be immune from unauthorised access to information stored in them.

By using the Site and its services, you acknowledge and agree to these limitations.

Right to Access Information

Under the Privacy Protection Law, 5741-1981, every person is entitled to review, personally or through a written proxy or guardian, information about themselves held in a database.

A person who has reviewed information about themselves and found it to be incorrect, incomplete, unclear, or not up to date may request the database owner to correct or delete the information. If the owner refuses, they must notify the applicant in the manner and form prescribed by regulations under the Privacy Protection Law.

A person may appeal against a database owner's refusal to allow access, or against a refusal to correct or delete information, in the manner and form prescribed by regulations.

Please note that deletion of information may prevent you from continuing to receive services from the Site and may result in cancellation of your registration. Information required by the Company, including a record of actions you performed on the Site, will continue to be retained by the Company as required by law, but will no longer be used to contact you.

If within 30 days you do not receive notice that the information the Company was asked to delete has indeed been deleted pursuant to this section, you will be entitled to apply to a court in the manner prescribed by regulations under the Privacy Protection Law, so that it may order the Company to act accordingly.

Changes to the Privacy Policy

The Company may amend the terms of the Privacy Policy from time to time.

If material changes are made to the policy, a notice will be published on the Site's home page 30 days before the changes take effect.

If other non-material changes are made to the policy, a notice will be published on the Site's home page 7 days before they take effect, unless changes are made pursuant to the provisions of any law or a competent authority's requirement, in which case the changes will take effect in accordance with those provisions or that requirement.

Continued use of the Site after a policy change indicates your acceptance of the amended policy. If you do not agree with the updated version of the policy, you must cease using the Site.
